Don’t Mess With Texas

So Barack Obama won the election and a lot of states are calling for secession.  Usually I would take this in the same vein as someone saying “if the other guy wins, I’m moving to Canada”.  But this time, I thought I would take a deeper look into the matter.

First of all, one must ask if secession is actually legal.  The answer, not only is it legal but it is plainly stated by the US Constitution as well as being out rightly encouraged by the Declaration of Independence.

To wit:

Tenth Amendment of the US Constitution:

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Declaration of Independence:

That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government

That pretty much covers the legality of it.  Since there is no actual prohibition to secession in the Constitution, in fact 3 states specifically (Virginia, New York and Rhode Island) reserved the right to secede when they ratified the Constitution, it can not be construed as anything but legal.

And what was the American Revolution if not a secession from the British Empire?

Speaking of warfare, you may be wondering about the Civil War.  Doesn’t that prove that secession is illegal? No, it only proved that, when allowed to act outside his lawfully limited authority, a U.S. president is capable of unleashing horrendous violence against the lives, liberty, and property of those whom he pretends to serve.

Unlike what Richard Nixon would later exclaim (“When the President does it, it’s not illegal”), if the President does something that goes against the Constitution or that he has no lawful right to do, it doesn’t all of a sudden make it right and legal.

So not only was the Civil War an unjustified response for the Union it also crippled States Rights forever.  Because at the end of the day, if a state cannot leave a government that becomes destructive and that it no longer believes in, the State itself becomes a slave.

The founding of this nation was that of Colonies seceding from a government it found intolerable.  Less than 100 years later the government formed would play out the same dance, but this time it was the oppressive government that would win.  Now, it is ironic that I call the Union oppressive as they have been characterized as acting in the war with the pretense of freeing slaves but in truth it was to keep the South in the Union and the fertile Southern plantations as a part of the United States.

Don’t believe me?  This is what ole Abe Lincoln had to say on the matter in a letter to Horace Greeley in 1862:

My paramount object in this struggle is to save the Union, and is not either to save or to destroy slavery. If I could save the Union without freeing any slave I would do it, and if I could save it by freeing all the slaves I would do it; and if I could save it by freeing some and leaving others alone I would also do that.

Was slavery an issue?  Yes.  Was it the main one? No.  To think it was would be akin to thinking that the first Gulf War was about protecting Kuwait and not about oil.

Oh, and by the way, what were the southerners using to defend themselves from Northern Aggression? That’s right, firearms.

So now we know that it is Constitutionally legal, is encouraged by our Founding Fathers and can only be stopped by a federal government that puts itself above the will of the people and its states (sorry abe but its true) let us look now as to whether it is feasible.

Since the election last week, citizens from all 50 states have started petitions to secede.  Now, while I do not understand the notion of sending a petition to the White House, who will now have your name and information, should they want to try and hang you for treason (yeah, secession is legal if you win, its treason if you lose. Founding Fathers understood that, the South faced that truth) lets discuss some of those states.

Just because you WANT to secede from the Union does not make it possible for you to actually survive if you did.  Take for instance Kansas.  What if ONLY Kansas seceded to make its own country.  It is a land locked state with no waterway access.  It ranks 32nd in the nations GDP and is not tremendously popular as a tourist destination.  Plus, depending on the wrath of the US Federal Government, the corporations that make their headquarters within Kansas may be forced to relocate if pressured by the US.  With these factors piling up, Kansas could quickly become like an interior African country without the bloodshed and genocide.

If we take North Dakota on the other hand, they are facing an energy boom, are known as the Saudi Arabia of Wind Energy and can continue to export that to the US or to Canada.  Though land locked like Kansas they have the option of opening up relations with Canada who may not be seeking retribution like the US might.  With the energy production and low taxes North Dakota could resemble an economy similar to those found in the Middle East.

Those are bad and neutral economic outcomes for two states.  Now its time for a good outcome and with that I turn to the state that is the namesake of this article; Texas.

Texas has a thriving economy and no state income tax.  They have a varied economical model that includes energy, industry, technology and tourism.  Plus they have access to the Gulf of Mexico and have a history of being their own Country.  If Texas was their own country all ready, their GDP would rank 14th IN THE WORLD.  If any state could not only survive but thrive without being a part of the United States, it’s Texas.

Other states would most likely have to band together and make a larger government than their one state in order to survive.  Not that there is anything wrong with that, it is just the reality of the matter.

Legality and feasibility aside the next question faced is SHOULD a state secede?  Maybe I should rephrase, is it worth it to secede because a man like Obama is driving this country into the toilet known as European Socialism?

This one is a little tougher to answer.  I think that just because the man wants to destroy what America is all about; capitalism, individuality, self reliance etc., doesn’t mean that he can necessarily extend it past the next four years.  So is secession a knee jerk reaction in order to temporarily avoid an un-American ruler that will be removed from the position of leadership or is it a reaction to the trend in which one sees this nation moving.

If it’s the latter I can understand the notion of secession.  With Obama packing the courts with like minded individuals, and entitlement programs that will be politically costly for a politician to remove (Obamacare) and the fiscal cliff that Obama is driving us full bore off of, maybe casting off the shackles of the Great Experiment’s mutation and returning to the basic formula is the right move.

I mean, between his abject disregard for the Constitution, his hatred of guns, his willingness to hand over American sovereignty to the United Nations and the fact that a majority (small though it was) of Americans thought that was a good idea might be an indication that this country has become too divided.

The person to blame?  Barack Obama.  He has sowed class warfare, social warfare, racial warfare and now must reap what he has sowed.

If some people want to take their state of like minded individuals and peaceably leave this sinking ship that is Obama’s America then I don’t blame them.  With luck, we have learned enough in the past 260 years to improve on the formula and not make the same mistakes.

First thing a new nation should do?  Nice clear language for the Bill of Rights.  As plain a vernacular as possible so the meaning cannot be construed 2 centuries hence by those looking to subjugate the people’s protection of liberty.  After that, keep on with the no income tax Texas, you’re doing fine there.  Other than that, Texas seems pretty good to go.

I doubt anything will come of it, but if Obama spends the next four years killing this country like he has the first four years, and in 2016 the ignorant elect someone to maintain his direction, then maybe some states jumping ship might not seem so far fetched.

Though I am inclined to finish this off with “Remember the Alamo”, I think it is better to remember the Declaration of Independence and Constitution.  Too many seem to have forgotten.

    Thank you for the fine article. I would only disagree slightly on one point. That being that blaming one person, Pres. Barrack Obama, is not sufficient. He is only part of the problem. The U.S. Federal Government has been moving quickly in this direction for decades and all three branches of that government have colluded to do so. President Obama has definitely sped up the process, but so very many others must be included in the tyrannical and treasonous demise of our Republic. I, like many others, did not just now start speaking out about the tyranny and rapid move toward totalitarianism. We’ve been warning about it and complaining to our government about for years. I do think that the recent election has spurred more people on to speak out, but it is not the root cause. God’s blessing to y’all.

    A fine point Al. Throughout this blog, you will find me touching on topics and people that have eroded the founding principles of America that transcend people and parties. From Bush’s civil liberty killing Patriot Act and TSA, and Reagan’s allowing the infringement of the Second Amendment to Woodrow Wilson’s devious enactment of the Private Bank the Federal Reserve and the IRS.

    I focus on Obama now, because as you say, he is speeding us toward the cliff and the secession movement seems to be spawned by his re-election. But you are correct, plenty of blame for plenty of people to go around.

    Al made it clear and I agree that it is the buerauacracy that is the real enforcer and most of them don’t go away with elections. The other point would be; What makes you so sure we will HAVE another election?

      A concern that is becoming seemingly more valid with each passing day Highlander. But I say, so long as we are armed we will have the power to overthrow a tyrants regime.

      Though if that tyrant comes for our guns (thus subsequently sowing the grounds for endless rule), then a decision must be made to either allow ourselves into voluntary servitude or to refresh the tree of liberty.

    Obama isn’t going to come for our guns. He is just going to make them impossible to buy. Its not the current generations that will have a choice, its future generations will no longer have a choice. Decisions need to be made, we fight now while we chance or we condemn our children to a life of servitude.

    The election is over. If you’re not happy, quitcherbitchin’ and do what you must….but, STOP your WHINING!!! Most of you already own a small arsenal, anyway….right? Are you going to voluntarily give-up your armory? I don’t think so.
    Life is good! Hug your kids. Thank the Lord for all you DO have. Let’s get this nation back on track. The President is doing what he can. Give the guy a chance. Get behind him and you can initiate REAL change.
    There is real power in numbers. By breaking-away from the Union, your strength diminishes.

      Not for not, but what if people don’t like the REAL change that obama intends? What if you’re a business owner who can’t pay the Obamacare tax? What if you are a gun aficionado who worries about the elimination of the 2nd Amendment? What about the college graduate who wants a job and not government dependency?

      Yes, Obama won and more people voted for him than the other guy…but not THAT many. If obama’s “REAL” change is initiated I feel it will destroy what America is. If other people want to secede from the Union based on that assumption and it turns out to be true, the real power won’t be in numbers but rather be separating the wheat from the chaff.

    Science is the root of development. With it you can go to the moon, eradicate disease, and create a computer that will surf the web. Just like the president, science has shown that he is taking us down the road of European socialism and that is not what our founding fathers wanted. All this is based on his history and everything up to now as we are slipping further into servitude.

    It would be foolish to think that in the next 4 years the president will go the other direction to complete his socialist utopia or seeing the error of his ways. Not going to happen. The longer we wait to secede the more difficult it becomes unless time serves in convincing others to joint in the movement. In time other states may see the destruction of the presidents agenda and decide to also secede from the union, but over all secession must be done as soon as possible before major financial ruin cripples the possibility of surviving apart from the union.

    -That’s what I am thinking.

    I agree… Nice article by the way. The problem is not just based on one mans current platform or position. It is a trend that seems will continue that People are reacting to. I have felt for the longest time that Liberalism has been the poison which courses through the veins of the American Political system. Now that it has anchored itself to a demographic of Americans who have become over abundantly dependant on the programs which this Government offers them, it will be almost impossible to get Liberals out of office simply by voicing our political aspirations at the Ballot-box.

    Once President Obama appoints more Supreme Court Justices to SCOTUS, which it is speculated that he will have an opportunity to do with-in the next 4 years, “We the People” can kiss our constitutional rights away. As each argument is heard, be it Religion, the 2nd Amendment, free speech, the right to privacy, etc.. will be voted against and struck down one by one by the new Liberal Supreme Court Justices acting as the Majority. And worse yet they will force their immorality down your throat and if you oppose or disagree you will be detained and charged for discrimination of protected minority rights regardless of your moral compass or religious beliefs.

    This is why so many people are initiating and signing petitions for secession. This country has not been this divided pitting the rich against the poor, the working class against those with-out jobs, Men against Women, a womans right to choose against a babies right to live, blacks against whites, Latinos against White Conservatives, Unions against Job Creators and conservatism against liberalism for a long time. Racially we have not been this divided as a Nation since the early 1960`s. President Obama has divided us as a Nation and his Army, the New Democratic Party being blindly lead by Liberals are here to place their foot on the throats of anyone who would oppose them,

    This looks as if it could and will get ugly and if talk of secession continues and more and more concerned citizens see it as an option to free ourselves from this Liberal oppression thought this medium then momentum will further advance this to possibly engaging in another Civil War, because you know that President Obama will not let the Country secede before placing the Country under Martial Law and threatening War if Necessary.

    The options are to start over again with the Constitution as the Center Piece of our Union and let people know from the start this is how this Government will be Governed in accordance to the Constitution, Bill of Rights and Ammendments and if you do not like it than move on. And all of these bleeding heart Liberals can move to Cuba, China or Russia and be happy with their fellow Comrades in arms.

    I find this blog interesting. What the author fails to really delve into is the practical considerations of secession. Remember the Alamo, for sure, but also remember that those battles were fought by AMERICANS, not just Texans. There’s a much older adage: “In unity there is strength” Texas may indeed have a thriving economy and no state income tax. What they also enjoy is the full faith, credit, and power of the rest of our states backing them up physically. I wonder how quickly Texas would descend into “Buffer State” or “Contended Territory” with Mexico should secession prove successful. How long would the state be able to function without heavily taxing it’s citizens to fund the self-protection forces they would clearly need to fend off an attack or the infiltration from the South? Who would they sell their oil and other products – to if the US cut off relations? I could go on for paragraphs, but in short, It’s a lot easier to contemplate the presumed benefits of emancipation (we all spent a lot of time thinking about it in high school) than it is with the devilish details of being completely self-sufficient.

      How heavy were the taxes needed to fund the Texan fight with Mexico in the first place? Remember, Texas won, without being part of the U.S. It had been part of Mexico.
